TERMS AND CONDITIONS OF USE

ACCEPTANCE OF TERMS Alumni.NET offers free service to its valued users. The user is thus expected to accept the following "Terms of Service"(TOS). Alumni.NET can update the TOS from time to time without giving notice to its users. You can review the current TOS anytime, at your convenience.

DESCRIPTION OF SERVICE Alumni.NET is a free service provided by Infophil.COM, Inc. . It is intended to bring school friends, co-workers and even long lost family members together and build rebuild or create online communities. The user is responsible for providing himself/herself all equipment necessary to access the service. He/she is also responsible in obtaining access to the service. Such access may include fees (e.g. fees for the Internet Service Provider) and the user is solely responsible for those fees.

REGISTRATION OBLIGATIONS The user must agree to provide true, accurate and current information about himself/herself, as prompted by the registration form. Alumni.NET reserves the right to delete a person's information and to refuse any and all future use if we suspect that the information provided is false and inaccurate.

PASSWORD The user is responsible for maintaining the confidentiality of his/her password and account, and for all activities that occur under his/her password or account.

USER CONDUCT The user must understand that all contents (information, data, text, photographs, videos, music, graphics and/or other materials) transmitted through Alumni.NET are the sole responsibility of the person from which such content originated. Alumni.NET does not control the contents sent via the service, therefore, the user, and not Alumni.NET, is entirely responsible for all contents that he/she uploads, emails and/or transmits. Alumni.NET does not guarantee the accuracy, integrity and quality of such contents. The user must also understand that it is possible for him/her to receive contents that are offensive, objectionable or indecent. Alumni.NET will not be liable for any error or any negative effect/result of such content.


The user agrees not to use the service to:

a. use the service to send any unsolicited or unauthorized advertising, promotional materials, "junk" mails, "spams", "chain letters", any form of solicitation and the like;

b. email any message with contents that are harmful, abusive, harassing, vulgar, obscene, libelous, hateful, invasive of one's privacy or the like;

c. email any material that contains software viruses or any files or programs designed to interrupt or destroy any computer software or hardware;

d. use the service to harass or "stalk" another;

e. use the service to ruin one's reputation;

f. interfere with or disrupt the service , servers or networks connected to the service.

Users shall respect that Alumni.NET does not pre-screen discussion board postings, photos, messages sent to fellow members via the website nor does it verify identities of the users and its memberships with organizations; only a confirmation of an existing email address is performed.

Users shall recognize that they have the responsibility of evaluating and bearing the risks associated with the content's (that is shared and used) reliability accuracy, usefulness, purpose and comprehensiveness. Consequently, users shall understand that they cannot entirely depend on the data Alumni.NET offers through its website and its services.

Alumni.NET may preserve as well as disclose its content if in good faith that such actions will be necessary to (1) comply with legal process; (2) defend and preserve Alumni.NET's rights and property; (3) enforce the terms and conditions of Alumni.NET; (4) make movements to guard and defend the interests of its members or others.

Users shall also understand that the technical processing of all data for the availability of the service includes transmission over various networks, as well as changes to adapt and conform to technical requirements of connecting networks and devices so that Alumni.NET may continue to be effective in providing its services.

SPECIAL WARNINGS FOR INTERNATIONAL USE Users shall remember that Alumni.NET is a website that caters to countries worldwide and that the Internet in itself is global in nature. Thus, it is necessary for the user to comply with applicable laws in their country with respect to acceptable content and conduct online. Furthermore users shall also be mindful and obedient to laws that are applicable to their respective countries regarding transmission of technical data exported from one's country to another.

LICENSE TO CONTENT IN ALUMNI.NET Users shall understand that Alumni.NET shall have license to use, modify, adapt, reproduce, publicly perform and display content made publicly available on Alumni.NET's services solely for the purpose for which it had been made available or submitted for. Moreover, Alumni.NET has the right (but not the obligation) to refuse or relocate content that is available through the website. Furthermore, Alumni.NET shall have the right to remove content deemed inappropriate, objectionable and violating the Terms & Conditions of Alumni.NET.

SPAM, ABUSE, MISUSE AND DAMAGES Alumni.NET values the privacy and trust of its users and maintains a strict policy against the abuse and misuse of the site, particularly at spam or unsolicited email sent by third parties. For the maximum protection of the users from abuse and misuse of the website, Alumni.NET will instantaneously ban and delete the account and email addresses of users/members which it believes, in its sole discretion, is abusive and is transmitting or connected to any spam or unsolicited email sending.

Any Alumni.NET member may report spam and website abuse by sending the entire abusive email/statement etc., found at the website to support@alumni.net so that damages may be appropriately incurred.

INDEMNITY The user must agree to indemnify Alumni.NET, its subsidiaries, affiliates, employees and other partners from any claim or demand, including lawyers' fees made by any third party due to the users use of the service or violation of the TOS.

MODIFICATIONS Alumni.NET reserves the right to modify from time to time or discontinue at anytime the service, with or without notice. Alumni.NET shall not be liable to the user for any modification to or discontinuance of the service.

TERMINATION The user should agree that Alumni.NET, in its sole discretion, may terminate your account, password or use of the service, for any reason or if Alumni.NET believes that the user has violated or has acted inconsistently with the spirit of TOS. Alumni.NET also in its sole discretion and at any time discontinue providing the service, with or without notice. Upon termination, user's right to use Alumni.NET immediately ceases. Otherwise, refunds are not permitted. Further, the user must agree that Alumni.NET shall not be liable to anyone for any termination of you access to the service.

ADVERTISERS The user's correspondence with or any business dealings with any of the advertisers found in Alumni.NET is solely between the user and the advertiser. The user should bear in mind that any loss or damage caused by such correspondence or dealings is not the responsibility or liability of Alumni.NET.

LINKS Alumni.NET also maintains a section called 'Related Links' at every organizational registry with Alumni.NET. The said section lists websites and resources related and relevant to the organization whose content Alumni.NET has no control of and therefore would not be responsible for. The links are added via users requests sent to Alumni.NET's Support Team that screen and verify the validity of the links. Users shall be responsible for being informed of the website's privacy statements and terms & conditions for such websites under Alumni.NET's related Links section.

DISCLAIMER OF WARRANTIES The user understands and agrees that:

a. the use of the service is at his or her sole risk. The service is provided on an "as is" and "as available" basis;

b. Alumni.NET makes no warranty that the service will be uninterrupted, error-free, timely, secure, and will meet his/her requirements or expectations;

c. any material downloaded or obtained in any way through the service is done at his/her own discretion. The user is solely responsible for any damage to one's computer system or loss of data that results from such download;

d. Alumni.NET shall not create any warranty to any information that he/she obtained through the service;

e. Alumni.NET will do its best to keep any and all data provided by the user, but in any unavoidable case that such data are lost, Alumni.NET should not be held liable.

LIMITATION OF LIABILITY The user should understand and agree that Alumni.NET shall not be liable for any damage, including but not limited to, monetary loss resulting from transactions with Alumni.NET advertisers, damage to one's reputation resulting from bogus entries.

TRADEMARKS & COPYRIGHT Alumni.NET logos, banners and the like are trademarks of Alumni.NET or Infophil.COM, INC. Without Alumni.NET's permission, the user agrees not to display or use these in any manner.

Alumni.NET respects the intellectual property of others. We expect the user to do the same. If the user believes that his/her intellectual property rights have been violated please inform Alumni.NET authorities immediately and provide the following information:

a. a description of the copyright that you claim has been infringed;

b. a description where the material is located on the site;

c. complete name, address, telephone number and email address of the owner of the copyrighted material;

d. signature, sent electronically or physically, of the person authorized to act on behalf of the owner of the copyright;

e. a statement by the user or owner that he/she firmly believes that the disputed use is not authorized by the copyright owner;

f. a statement, made under penalty of perjury, that all the given information are true and accurate and that he/she is the copyright owner or the one authorized to act on behalf of the copyright owner.

GENERAL INFORMATION The Terms and Conditions constitute the comprehensive agreement between the user and Alumni.NET and guides users in the use of Alumni.NET, superseding prior agreements between the user and Alumni.NET. Users may still be governed by the terms & conditions of other services of Alumni.NET e.g. Alumni.NET's affiliate program as well as third party content and websites and software. The Terms and Conditions and the relationship between the user and Alumni.NET shall be subject to the laws of Makati City, Metro Manila, Philippines with regard to the provisions and any conflict that would arise from the agreement. The user and Alumni.NET shall abide under the jurisdiction of the courts at Makati City, Philippines. If Alumni.NET fails to exercise or enforce any right or provision of the Terms and Conditions, it shall not constitute a waiver of such right or provision. Moreover, if any provision of the Terms and Conditions is found by a court of qualified jurisdiction to be invalid, the parties agree regardless that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect. The user agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.

VIOLATIONS Alumni.NET encourages users to report any violation in the terms and conditions stated above for appropriate corrective actions to Alumni.NET's Support Team via email at support@alumni.net.
